Flix50 YouTube Contest – Official Contest Rules
1. Eligibility- The contest is open only to legal residents of Canada.
- You are not eligible to enter if you are:
(i) an employee, representative or agent of York University, its advertising or promotional agencies, professional representatives, printing suppliers, licensees, the prize supplier or a member of the jury;
(ii) a retailer on any of York University’s campuses; or
(iii) a member of the immediate family of any of the above persons (i.e. spouse, child, sibling, parent) or a member of the household of any of the above persons.
2. How To Enter
- To enter: upload your video to www.youtube.com and fully complete the contest entry form on http://www.yorku50.ca/flix50/form.html. There is no purchase necessary to enter the contest.
- You may submit only one (1) entry for each of the monthly contests.
- To be eligible for the monthly contest, the contest entry form must be received, and your video submission uploaded, on or after 12:00 am (E.S.T.) on the first day of the month, with the exception of the April contest which begins 12:01 am on March 26 (except in the province of Quebec, where entry for the April contest begins 12:01 am on April 5), and on or before 11:59 pm (E.S.T.) on the last day of the month. The eligibility dates for each contest are as follows:
April contest: March 26, 2009 (in Quebec, April 5, 2009) – April 30, 2009
May contest: May 1 – May 31, 2009
June contest: June 1 – June 30, 2009
July contest: July 1 – July 31, 2009
August contest: August 1 – August 31, 2009
September contest: September 1 – September 30, 2009
October contest: October 1 - October 31, 2009
November contest: November 1 – November 25, 2009 - The winners of each of the monthly contests will be entered into the grand-prize contest to be held from December 1 – December 7, 2009.
- All entries become the property of York University.
- York University is not responsible for late, lost, incomplete, illegible, misdirected, stolen, delayed, damaged or destroyed entries, or for any unavailable network connections, failed, incomplete, garbled, or delayed computer transmissions, on-line failures, hardware, software or other technical functions or disturbances or any other communications failures or circumstances affecting, disrupting or corrupting the contest in any manner.
3. Prize
- Each of the monthly contest winners will be selected by the Flix50 Jury at York University, by 5:00 p.m. E.T. the day following the close of each monthly contest.The grand-prize winner will be selected by 5:00 p.m. E.T. on December 8, 2009 at York University, following the close of online voting conducted on the contest website at http://www.yorku50.ca/flix50/form.html between December 1, 2009 and December 7, 2009 (voting closes at 11:59pm on December 6).
- The selected entrant will be contacted within ten (10) days of the selection by telephone or e-mail. If the selected winner cannot be contacted within that time or does not comply with these Official Contest Rules, the prize will be forfeited and an alternative eligible entry will be selected. York University is not responsible for the failure for any reason whatsoever of a selected potential winner to receive notification or for York University to receive a selected potential winner's response.
- Each month’s video entrants will be judged by the Flix50 Jury according to the following criteria: creativity, humour, sentimentality and technical prowess. If more than 15 videos are submitted in a month, the videos will be judged on the above stated criteria by a York staff jury, and the top 15 will then be judged by the Flix50 Jury.
- The winning video from each month’s contest will be entered into the grand prize competition. These videos will be voted on by the public through an online poll on www.yorku.ca/flix50. In the event of a tie, the winner will be selected based whose video had the best score in the monthly contest.
- You should refrain from including in your video submission any clothing or items bearing logos or third party trade-marks (other than those of York University or your own authorized logos or trade-marks), the name or likeness of any celebrity, living or dead, or other content owned by third parties (e.g. music, art, performances, etc.).
- In order to win any of the prizes, the eligible entrant must first correctly answer a mathematical skill testing question administered by e-mail or telephone.
- The winner of each monthly contest is to receive EITHER: (a) $100 Best Buy Gift Certificate; or (b) a $100 York University Bookstore Gift Certificate. The winner may choose between (a) and (b).
- The grand prize is a $2000 voucher redeemable at Air Canada. The voucher must be accepted by the winner as awarded and is not transferable. Any taxes and fees above the prize value will be the responsibility of the winner. The prize includes only the air travel tickets. Transport to and from the airport, and any airport taxes, are not included. In-flight meals, drink service and reserved seat selection may be included only if they are normally included with tickets for the chosen fare and destination, had they been included. No cash alternative or substitution of any prize is provided, except that York University, in its sole discretion, reserves the right to substitute a prize of equal or greater value if the prize is unavailable for any reason. The prizes are provided “as is” without warranty of any kind and must be accepted as awarded. York University disclaims all warranties including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement.
- The odds of winning a prize depend on the eligible entries received.
- The grand prize is not transferable unless authorized in writing by York University before the transfer is made. Such authorization may be granted or withheld in York University’s sole discretion.
- Any applicable taxes are the responsibility of the winner.
- In order to be declared a winner, the selected potential winner will be required to swear an affidavit indicating eligibility and compliance with these Official Contest rules. In the event that the winner has not yet reached the age of 18 years or the age of majority in the winner’s province or territory of residence, then the winner’s parent/legal guardian must sign the affidavit to confirm compliance and consent with these Official Contest Rules and to accept the prize on behalf of the minor, and provide a release and indemnity pursuant to Subsection 4(d) below.
4. Conditions of Participation
By participating in this contest, you agree:
- no purchase is necessary to enter or win;
- to be bound by these Official Contest Rules and the decisions of York University, whose decisions are final;
- to the use of your name, video submission (in part or whole), likeness, voice, image, recording, video footage and statements in connection with this contest and the promotion and exploitation thereof, and the advertising and/or promotion thereof or of your video submission, without compensation;
- you are the sole owner of all right, title and interest (including copyright) in and to the your video submission;
- by providing your video submission to York University, you shall grant to York University a worldwide, perpetual, royalty-free, irrevocable, and exclusive license to copy, use, modify, reproduce, display, adapt and transmit your video submission for use in all media now known or hereafter devised in connection with this contest and the promotion and exploitation thereof, and the advertising or promotion of York University, without further compensation to you or any third party; if you are not selected as the grand prize winner you retain all right, title and interest (including copyright) in and to the video submission; if you are selected as grand prize winner, as a condition of accepting the grand prize, you shall assign all right, title and interest (including copyright) in and to the video submission to York University, and sign any documentation required by York University to demonstrate this assignment, without further compensation to you or any third party;
- your video submission is an original work, solely created by you, and that no third party participated as a co-author or otherwise in the creation of the video submission, or any part thereof, and that York University may use your video submission for the purposes above without further compensation to any party;
- you waive all moral rights in the video submission;
- you assume all responsibility for any claims of infringement of rights to privacy or personality, and all such liability remains with you;
- you represent to York University that your video submission does not infringe any copyright interest of any third party and that the video submission is not defamatory or obscene and does not violate any laws relating to hate speech or otherwise;
- York University reserves the right to exclude any video submission on the basis of concerns relating to the rights of third parties, including but not limited to privacy, copyright, defamation, rights of personality, obscenity, hate speech, as determined by York University in its sole discretion;
- you have read, agree with, and accept these rules, and are subject to the Terms of Service and Privacy Policy of YouTube, found at http://www.youtube.com/t/terms and http://www.youtube.com/t/privacy
respectively, in order to upload your video submission to YouTube; - that if you are selected as a winner, you give York University and its agents the right to publish or broadcast your name, likeness, voice, image, recording, video footage or statements for editorial, promotional, advertising and publicity purposes, without compensation other than the value of the prize offered; and
- to release and indemnify and hold harmless York University, its advertising and promotional agencies, the prize suppliers, and all their respective officers, directors, employees, owners, agents, contractors, representatives, successors and assigns from any liability in connection with or arising out of this contest, the awarding of the prize, the use of any personal information or the use of merchandise purchased in relation to winning a prize.
5. Termination
Subject to the jurisdiction of the Régie des alcools, des courses et des jeux in Quebec, York University also reserves the right, without prior notice, and at any time, to terminate the contest, in whole or in part or modify, suspend or extend the contest in any way.
6. General Provisions
- In the event that York University is prevented from continuing with the contest by an event beyond its control, York University has the right to modify, suspend, extend or terminate the contest, subject to the jurisdiction of the Régie des alcools, des courses et des jeux in Quebec.
- All entries become property of York University upon receipt and will not be returned and no correspondence will be entered into except with selected potential winners.
- The invalidity or unenforceability of any provision of these Official Contest Rules does not affect the validity or enforceability of any other provision.
- This contest and these Official Contest Rules are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
7. Privacy Notice
Personal information in connection with the contest is collected under the authority of The York University Act, 1965 and will be used for the administration of the contest and related purposes. 8. Quebec Residents
FOR RESIDENTS OF QUEBEC: Any litigation respecting the conduct or organisation of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie only for the purpose of helping the parties reach a settlement.
